I am looking to lay fav in running if it goes to 5.0, can this be done via automation?

Yes, you just need a fixed odds condition to test the price

Its up to you if you want to set the 'Favouritism sort' to 'Actual SP' in your main automation settings area, and that will allow you to apply the rule 'By position (sorted in order of favouritism)' 1
Or trigger a 'Set/Modify Signal' rule and set a signal on the Fav at the off
Then also add a 'Signal 'Set' condition to your lay rule to test the selection the lay bet is about to trigger on was the Fav at the off

In play the favourite could be changing all the time and so if "current" fav SP > 3.9 the rule won't fire.
Not sure if that explains what's happening but it is a reason why the rule may not fire every race.
