If he incited violence then he should be charged by the police. I'm not so sure he did.
It all depends on the legal definition in the US, but he certainly could be reasonably expected to know that his actions are likely to cause violence. I agree he should be arrested and charged by the police but I'm not sure how you arrest a president.
